2. Trend signal — why now?
Article 50 of the EU AI Act becomes enforceable on 2 August 2026 — no SME exemption. It is the transparency layer that catches almost every European business now using ChatGPT, Midjourney, Synthesia, ElevenLabs, HeyGen, Veo or Sora for client work. Four hard-coded duties land that day on any “deployer” producing AI content for natural persons in the EU:
- Any chatbot or voice assistant must disclose to the user that it is AI, at the point of interaction.
- Any AI-generated text, image, audio or video output must be machine-readable as artificially generated (C2PA, SynthID, IPTC metadata).
- Any “deepfake” or AI-manipulated image/audio/video must carry a visible label (the standardised “AI” icon, fixed position).
- Any emotion-recognition or biometric categorisation system must notify the people exposed to it.
Penalty ceiling: €15M or 3% of global annual turnover, whichever is higher.
The May 7 2026 Digital Omnibus deal pushed Annex III high-risk obligations from Aug 2 2026 to Dec 2 2027 — but it explicitly leaves Article 50 transparency untouched. Bird & Bird, Jones Day, Hogan Lovells, Gibson Dunn, Latham & Watkins and Travers Smith have all confirmed in May 2026 that “Article 50 remains a live compliance date.” If the Omnibus is not formally adopted before 2 August 2026, even the high-risk provisions snap into effect on day one.
European Commission’s second draft Code of Practice on AI-generated content labelling (Jan 2026) names C2PA Content Credentials as the de facto reference, with the standardised “AI” icon and “fully AI-generated” vs “AI-assisted” taxonomy. Final version expected June 2026 — six weeks before enforcement.
The customer voice is loud and exactly where you’d expect it — German marketing newsletters, French agency Slack channels, Bird & Bird and DLA Piper blogs (“most marketing agencies don’t even know whether it applies to them” — Seresa, Apr 2026). 3. The opportunity
The European AI-content compliance market in mid-2026 is split into two bad options:
- Enterprise-grade compliance suites (OneTrust, TrustArc, Bria.ai, TrueScreen, Credo.ai) — built for Fortune 500 chief AI officers, priced at €15K–€60K/yr, scoped to “AI governance program” not “stamp my Synthesia avatar before Tuesday’s client deliverable.”
- DIY — open-source C2PA SDKs, hand-rolled WordPress plugins, copy-pasted “made with AI” disclaimers in the footer, none of which actually satisfy Article 50’s machine-readable + visible + at-point-of-interaction trilogy.
The gap is the 5-to-15 person marketing/creative agency in Munich, Madrid, Milan or Marseille that produces 40-200 customer-facing AI artifacts per month (blog posts, email creatives, social images, voice ads, explainer videos, chatbot scripts) for SMB clients. They cannot afford €15K/yr OneTrust. They will pay €49–€199/mo for a tool that drops into Canva, Figma, ChatGPT, Synthesia, HeyGen, ElevenLabs, Make.com and n8n and auto-applies the right disclosure at the moment of export. The wedge is the same one Calendly, Loom and Cal.com used: collapse a multi-step compliance ritual into one stamp at the publish step, leave the rest of the workflow untouched.
There is also a non-obvious second wedge: proof of compliance. When the CNIL or Italian Garante writes the first SMB letter in Q4 2026, what the agency actually needs is not the watermark — it’s the audit trail showing every artifact was disclosed, when, with which metadata, signed by which operator. That’s the binder you sell.

6. AI angle — what’s load-bearing
Three places AI does the actual work, not decoration:
- Classify the artifact. The extension/API has to decide in <200ms whether what just left ChatGPT or Canva is “fully AI-generated”, “AI-assisted (substantial human edit)”, “deepfake-class manipulation of real people”, “AI-generated voice clone”, or “boring stock photo with AI background removed.” The Code of Practice taxonomy demands different disclosure levels for each. A cheap multimodal vision LLM (Claude Haiku, Gemini Flash, GPT-4o-mini) does this classification at <€0.001/artifact.
- Pick the right disclosure language in the user’s locale, for the right artifact type, per the latest version of the Code of Practice. Templates are rule-based but the matching is LLM-mediated; Article 50 wording is evolving monthly and a static template library breaks fast.

Medium. The build is mostly integration work: a stable C2PA SDK exists open-source (contentauthenticity.org), browser-extension scaffolding is solved, multimodal classification is one cheap API call per artifact, regulator scraping is straightforward. The hard parts are (a) keeping the disclosure-language library current as the June 2026 Code of Practice and national-DPA guidance evolve weekly — that’s a part-time compliance counsel retainer, not engineering — and (b) the multi-tenant audit-binder workflow with cryptographic chain-of-custody, which is meaningful but not novel.
